Effective Date: July 1, 2025

This Acceptable Use Policy (“AUP”) outlines the types of conduct, content, and materials that are prohibited by MAN IT Cloud (“MAN IT Cloud”, “MAN IT” “we,” “us,” or “our”) when using our services (“Services”). This AUP is incorporated by reference into your Terms & Conditions. By using any of our Services, you agree to comply with this AUP. Any violation of this AUP may result in the immediate suspension or termination of your Services, with or without notice, and without refund.

1. General Principles

1.1. The Services provided by MAN IT Cloud may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any applicable law, regulation, or this AUP is strictly prohibited. 

1.2. Clients are solely responsible for the content stored and transmitted under their account and for ensuring their use of the Services complies with all applicable laws in Bangladesh and international jurisdictions. 

1.3. MAN IT Cloud reserves the right to be the sole arbiter as to what constitutes a violation of this AUP and may take immediate action to prevent harm to its network, clients, or the wider internet.

2. Prohibited Content

The following types of content are strictly prohibited on MAN IT Cloud’s servers and network:

2.1. Illegal Content: 

* Child pornography or any other sexually explicit material involving minors. 

* Content that promotes or facilitates illegal activities (e.g., drug dealing, illegal arms trade). 

* Content that is defamatory, libelous, or maliciously false. 

* Content that promotes hate speech, discrimination, or violence against any individual or group based on religion, race, ethnicity, gender, sexual orientation, disability, or any other characteristic. 

* Content that violates any laws of Bangladesh or international laws (e.g., anti-terrorism laws, cybercrime laws).

2.2. Copyright and Intellectual Property Infringement: 

* Hosting, distributing, or linking to pirated software, cracked versions of software, or warez. 

* Distributing copyrighted music, movies, books, or any other copyrighted material without proper authorization or license. 

* Hosting or linking to material that infringes upon trademarks, patents, trade secrets, or any other proprietary rights of any third party. 

* Any content that violates the Digital Millennium Copyright Act (DMCA) or similar intellectual property laws. Upon receipt of a valid DMCA or equivalent notice, we will take appropriate action.

2.3. Harmful or Abusive Content: 

* Malware, viruses, worms, Trojan horses, or any other harmful or destructive code or programs. 

* Phishing websites, pharming, or other deceptive practices designed to trick users into revealing personal or financial information. 

* Content that advocates, promotes, or facilitates terrorism or other acts that could lead to loss of life or significant property damage. 

* Sites promoting hacking, cracking, or other illegal activities.

2.4. Adult Content (Strict Prohibition): 

* Pornography and sex-related merchandising are strictly prohibited on any MAN IT Cloud server. This includes, but is not limited to, sites that may infer sexual content, link to adult content elsewhere, or promote any explicit sexual activity. This is in adherence to our upstream provider’s policy and our commitment to maintaining a clean network.

2.5. Gambling and Illicit Financial Activities: 

* Hosting, linking to, or promoting online gambling, casinos, or other forms of illicit financial activities that violate the laws of Bangladesh or international jurisdictions.

2.6. Facilitating Illegal Acts: 

* Any content or activity that facilitates, encourages, or enables any illegal or unlawful act.

3. Prohibited Activities

The following activities are strictly prohibited when using MAN IT Cloud’s Services:

3.1. Spamming and Unsolicited Commercial Email (UCE): 

* Sending unsolicited bulk and/or commercial email (spam) from or through MAN IT Cloud servers, or using a return email address that is maintained on a MAN IT Cloud server, is strictly prohibited. 

* Using spam to advertise a site hosted on MAN IT Cloud’s network is also a violation. 

* Operating an open SMTP relay is prohibited. * Any violation will result in immediate account suspension or termination and may incur a clean-up fee of  BDT 20,000 / $200 per incident.

3.2. Resource Abuse: 

* Excessive Resource Usage: Consuming excessive amounts of CPU, RAM, disk I/O, network bandwidth, or other server resources that negatively impact the performance, stability, or security of our servers for other clients. This includes, but is not limited to: 

* Running any type of interactive online game. 

* Running public proxy servers or anonymous proxy services. 

* Running IRC bots, torrent applications, or any other Peer-to-Peer (P2P) file-sharing applications. 

* Running any script that causes a server to slow down or crash. 

* Using the Services primarily for file storage (file hosting services), data warehousing, or off-site media storage not directly related to your website’s operation. 

* Operating a public mirror site. 

* Specific Resource Limits: Clients on Shared Hosting, Managed Business Hosting, and Managed WordPress Hosting plans are subject to specific resource limits outlined in their respective plan specifications on our website. Exceeding these limits may result in suspension or a requirement to upgrade.

* Inode Limits: Managed, Shared and Reseller hosting accounts have inode limits 250,000 [certain Highest tier accounts have up to 350,000 inodes]. and 2,000,000inode limits for VPS per cPanel account. Exceeding this limit may result in suspension or a request to reduce inode count. 

* Database Usage: Excessive database queries, frequent or large database changes, or using our database servers as a remote hosted solution are prohibited. Remote database access is for administrative purposes only. [database query limits: 3,000 queries/hour total, 1,000 insert/update/delete queries/hour,Additionally, there is a restriction of 30 concurrent MySQL connections]

3.3. Network Abuse: 

* Attempting to gain unauthorized access to any network, server, or account not belonging to you (“hacking” or “cracking”). 

* Running port scans, security scans, or any network reconnaissance tools against our servers or any other network. 

* Distributing Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks against any network or server. 

* Interfering with or disrupting any services or networks connected to MAN IT Cloud’s network.

3.4. Email Abuse: 

* Sending emails with falsified header information. 

* Sending unsolicited bulk email (UBE) or unsolicited commercial email (UCE). 

* Operating a mailbombing program. 

* Maintaining an open SMTP relay. 

* Engaging in any practice that generates excessive bounces or complaints. 

* Email sending limits are applied per hour/day [100 emails/hour, 2000 emails/day, 100 recipients/email].

3.5. Reselling (Where Prohibited): 

* Reselling of hosting services is strictly prohibited on Web Hosting, Shared Hosting, Managed Business Hosting, and Managed WordPress Hosting plans. If reselling is desired, a dedicated Reseller Hosting plan must be purchased.

3.6. Backup Storage: 

* MAN IT Cloud’s servers are not allowed to be used as a primary backup/storage system for files not related to your active website. Off-site media storage is not permitted. You should have local copies of your backups.

4. Security

4.1. You are responsible for ensuring that your account is secure, including maintaining strong passwords and keeping all scripts, applications (e.g., WordPress, Joomla), themes, and plugins updated to their latest security patches. 

4.2. Failure to secure your account, which leads to compromise or abuse, may result in immediate suspension. 

4.3. You must promptly report any security vulnerabilities or suspected compromises of your account or our services to us.

5. Violation and Enforcement

5.1. MAN IT Cloud will investigate all reported violations of this AUP. We reserve the right to determine what constitutes a violation in our sole discretion. 

5.2. Upon detection of a violation, MAN IT Cloud may take one or more of the following actions: 

* Issue a warning. 

* Suspend your Services with or without notice. 

* Terminate your Services with or without notice, and without refund. 

* Apply a clean-up fee or other charges related to the violation. 

* Remove or disable content that violates this AUP. 

* Report the violation to appropriate law enforcement authorities. 

* Take legal action to recover damages or enforce compliance. 

5.3. A failure to respond to an email from our abuse team within 24 hours, or as otherwise specified in the communication, may result in the suspension or termination of your Services. 

5.4. MAN IT Cloud’s right to take action against any violation is not limited to the actions listed above.

6. Indemnification

6.1. You agree to indemnify and hold harmless MAN IT Cloud from any claims resulting from your use of the Services which damages you, MAN IT Cloud, or any other party. This includes any claims arising from content hosted by you or activities conducted under your account that violate this AUP.

7. Reporting Violations

7.1. If you become aware of any violation of this AUP, please report it to us immediately at legal@manitcloud.com. Please provide all relevant details, including the domain name, IP address, description of the violation, and any supporting evidence.

8. Changes to the AUP

8.1. MAN IT Cloud reserves the right to modify this AUP at any time without prior notice. Any changes will be effective immediately upon posting to our website. Your continued use of the Services after such modifications constitutes your acceptance of the revised AUP.
